Mohmed v Virgin Trains (ET 2201814/04)
Mohsin Mohmed worked as a Customer Service Assistant for Virgin Trains at London Euston Railway Station. Mohmed was not kept on after the end of his probationary period, with Virgin citing a "general lack of enthusiasm" on his part.
Mohmed claimed indirect and direct religious and racial discrimination claiming that he was told not to wear a skull cap and that was repeatedly asked by his manager to "do his trick" – to demonstrate that he kept his beard one fist’s length, as part of his faith as a Muslim.
His claim was rejected by the Employment Tribunal. They found that he had been dismissed for poor performance and that Virgin had tried to accommodate his religious beliefs by allowing his beard and skull cap, requesting that he keep his beard neat and that his headgear was in Virgin’s corporate colours.
